Liability and Insurance of Château de Montmirail
Château de Montmirail remains liable, according to French law, for bodily injury and/or material and/or consequential damages it may cause to third parties, including its clients, for damages occurring during their contractual stay.
Château de Montmirail declares that it has subscribed to a Multi-Risk Insurance policy covering its professional civil liability toward third parties and/or its clients, as well as damages that may occur to its real estate, furniture, products, and goods, including those related to guest room rentals and/or dining services.
Client’s Liability and Insurance
Liability toward third parties
The client remains responsible for any damages caused by themselves, their employees, or guests to any third party, the property of Château de Montmirail or its staff and/or caretaker, the potable water distribution installations within the Château de Montmirail grounds subject to intercommunal easement, or the environment due to air or soil pollution.
“Rental Risks”
According to the provisions of the French Civil Code, particularly Articles 1732 to 1736, the client is presumed responsible for any damages or losses occurring during their rental period unless they can prove that these occurred without their fault. They are liable for any fire damage unless they can prove that the fire resulted from an unforeseen event, force majeure, construction defects, or was caused by a neighboring property.
Upon booking, it is strongly recommended that the client check with their “Multi-Risk Home Insurance” provider to ensure that their rental liability is covered; this is generally included without an additional premium under a “leisure” clause, covering both third-party liability and rental risks.
